Guidance on the Expiration of 178 US Section 301 Tariff Exemptions in 2026: Deadline, Affected Categories, and Importer Response Plans

At 11:59 PM Eastern Time on November 9, 2026, these 178 Section 308 tariff exemptions for goods from China will expire on schedule. The USTR has neither issued an extension notice nor initiated a public comment period.

For US importers, this is not a "potential cost increase," but a certain expenditure that is already on a countdown. We will outline the core rules of this exemption expiration, the affected categories, and feasible response plans to help importers avoid additional tariff costs in the final window.

I. Core Rules: The sole criterion for determining eligibility is the date of entry and release for consumption; there is no transition period.

The expiration date for these 178 tariff exemptions is 11:59 PM Eastern Time on November 9, 2026. The sole criterion for determining whether a tariff exemption is eligible is the date when the goods have completed "entry and release for consumption."

• Goods cleared by customs before 23:59 on November 9th: Continue to enjoy the corresponding tariff exemption.

• Goods in a pending state (e.g., sea transport, airport clearance, customs queue): As long as they haven't been "released upon arrival" before the deadline, all applicable taxes will apply.

Special Note: This exemption has no extension, no phased implementation, and no buffer period; it's a hard deadline. Any judgment that "it's fine as long as the goods have arrived" or "a day or two later won't have a big impact" could result in full additional tariff payments, directly eroding profits for that category.

II. Which imported goods are affected? Breakdown of 178 Exempt Tariff Codes and Categories

The 178 tariff exemptions expiring this time cover two major tariff categories, concentrated in the industrial and high-end manufacturing categories:

1. 164 items corresponding to tariff code 9903.88.69: covering categories such as industrial machinery and spare parts, specialty chemical raw materials, and medical equipment parts.

2. 14 items corresponding to tariff code 9903.88.70: for photovoltaic production equipment.

If you happen to fall into this category, the bill three days later will be very detailed: goods on List 1 to 3 will have a 25% tariff reinstated, and goods on List 4A will have a 7.5% tariff reinstated, on top of the regular tariffs and taxes. For high-value industrial equipment and photovoltaic production line equipment, the overall import cost per shipment will jump significantly.

Back on November 26, 2025, when the USTR announced this exemption extension, it clearly stated that it was to "provide sufficient adjustment time for US importers." Now that the one-year adjustment period has ended, the essence of the exemption remains "temporary suspension of tariffs," not "permanent cancellation of tariffs." Importers need to plan your supply chains based on long-term tariff levels.

III. 3 Days to Go: 3 Actions Importers Can Take

With only 3 days left until the deadline, there are still actionable steps to reduce or even avoid this tariff cost increase:

1. Verify each 10-digit HTSUS tariff code to thoroughly investigate high-risk goods.

Compare each 10-digit HTSUS tariff code item by item, avoiding judgments based on "probably," "it seems," or "it shouldn't be on the list." Please take all U.S. Customs tariff codes for goods in transit, awaiting clearance at port, or awaiting release, and compare them one by one with the 178 exemption list. Focus on industrial machinery parts, photovoltaic production line equipment, medical equipment, and specialty chemicals to avoid missing the opportunity to respond due to misjudgment of tariff codes.

2. Coordinate Customs Clearance Resources and Prioritize Release Before the Deadline

For high-risk goods that have arrived at US ports/airports but have not yet completed customs clearance, immediately coordinate with customs clearance service providers to initiate expedited processing:

• Complete all customs clearance documents in advance to ensure accurate declaration information.

• Prioritize the declaration order for shipments with high tariff costs.

During these 3 days, the response speed of the logistics end directly determines whether or not this tax will be paid; this is currently the most critical cost control point.

3. Calculate Air Freight Costs and Benefits, Trading Freight Costs for Tariff Costs

For high-value, high-tariff goods still in China and not yet shipped, it is recommended to immediately calculate the costs: Has the additional 301 tariff expenditure for the goods approached or even exceeded the freight difference between sea and air freight?

If the answer is yes, then upgrading from sea freight to air freight/air delivery service is not simply an increase in "freight costs," but rather a cost optimization solution of "using a controllable freight premium to avoid higher tariff losses."
